In many cases, you will have a choice about whether to file a case in the federal or state courts. Bankruptcy and intellectual property disputes, however, are important exceptions; these cases may only be tried at the federal level, in the District Court of Michigan. In terms of civil cases, Circuit Courts rule on cases involving more than $25,000 while District Courts oversee cases involving settlements less than $25,000.

Access to the State of Michigan District Court and circuit court proceedings are generally open to the public, but a few restrictions apply. Michigan District Court Laws and Regulations, as well as circuit courts, do not allow minors to attend trial proceedings involving scandal and immorality. Circumstances that may prevent an individual's access to trial proceedings include situations where the defendant's right to a fair trial would be in jeopardy due to the influencing of the jury, or in grand jury proceedings, sidebar or chambers conferences and juvenile court proceedings if the victim or party requests the proceedings closed.

The Michigan Circuit Court also oversees appeals from the MI District Court, Probate Court and administrative agencies. Individuals may also research Mi Circuit Court records for select counties online by querying the party's name.

I recommend: Several of Michigan’s Circuit Courts judicial circuits have their own specific local court rules, which outline the procedures for submitting forms for various phases of the judicial process, rules pertaining to pre-trial procedures and mediation. The United States Federal Courts has two District Courts in Michigan, the Eastern and Western District Courts. The Eastern District Court has offices in Detroit, Ann Arbor, Bay City, Flint and Port Huron while the Western District Court has offices in Grand Rapids, Kalamazoo, Lansing and Marquette. While both the Eastern and Western District Courts offer a variety of services and resources, both clearly demonstrate technological innovation with the implementation of an electronic case filing system that attorneys must utilize to file documentation for civil and criminal court cases.

Local court rules

Local court rules are those rules (which are consistent with federal law and federal rules of practice and procedure) adopted by a court to address and establish procedures for those court.

I recommend: Obtain local rules for Michigan’s federal district courts by visiting the Eastern District and Western District websites.

Federal Supplement

United States District Court opinions and decisions, as well as those from the United States Court of International Trade (formerly the United States Customs Court) and the Judicial Panel on Multidistrict Litigation from 1933 to 1998 are available in hardbound books called the Federal Supplement. To assist the user, headnotes, key numbers and synopses accompany each case presented.

Protection of Juror's Employment Statute

It is inevitable that at one time or another, an employee will receive a summons for jury duty for United States District Court. The Protection of Juror's Employment Statute prohibits the termination or any other form of intimidation of an employer towards an employee summoned for federal jury duty.

Electronic Case Filing

The Eastern and Western District Courts of Michigan implemented an electronic case filing procedure for documentation pertaining to civil and criminal cases. A benefit of this process is that it allows attorneys to file documentation 24 hours a day, seven days a week.
