Finding an applicant with the right job qualifications is only part of the hiring process. Background checks should be essential because the employer can be held responsible for an employee’s actions on the job. CA public records can help identify individuals that could be a poor choice due to their credit or criminal history. Employers must also specifically check people who will be working with children or the elderly for any history of abuse.

There are three types of public records of particular interest when performing background checks:

1. Credit reports that show current lines of credit, payment histories and declarations of bankruptcy.

People who work with children or the elderly must have a record that is clear of abuse. Likewise, an employer may be wary of a person who has a record of sexual assault or violence, because the employer can be held responsible for the person’s actions on the job if a California background check turned up problems. On the other hand, the employer must be cognizant of the federal Fair Credit Reporting Act, which sets the U.S. standard on employment background checks, and the California version, which gives the employee greater rights.

There are three general types of public records in California:

Public records contain many different types of information that can be used for a variety of reasons. Examples of the types of information include the following key terms.

Contractors state licenses

If contemplating construction services, check that the contractor is licensed to do the work. The Contractors State License Board (CSLB) provides this as well as citations, licenses, complaint investigations, license suspensions and possible criminal, civil and administrative sanctions against those who are in violation.

I recommend: The California Department of Consumer Affairs Contractors State License Board has a huge amount of educational materials as well as the capability to do an online check of any licensed contractor.

Sex offender registration and exclusion information

The Justice Department of California maintains a list of all sex offenders who reside in California through the Sex Offender Tracking Program.

Tax defaulted land sales

Property that have unpaid taxes are tax-defaulted. After 5 years, it then is subject to sale by the county tax collector in order to pay the defaulted taxes. This can be done by public auction, sale negotiated to a public organization or a sealed bid type sale.

I recommend: Public auctions are held by the California State Controller's Office which posts dates of auctions, land location details and bidding guidelines for anyone who is interested in investigating the purchase of these types of land.
