What legal steps should be taken if my website design, content, and images were stolen?
I have a website for my company and the content and images on my site have been plagiarized under a different URL; with a very similar website design to mine as well. I have notified the owner of the site but received no response. What legal actions can be taken, if any?
I am not an attorney, rather a web designer, therefore; my question is..were they your original pictures or did you have a web designer find them for you? There are many times the same pictures are used on multiple web sites. I, personally, alter every picture just a little in order to know that there will NEVER be a duplicate, however; most people will not.
Is your company in China?
If it is in China, I highly suggest the following steps:
1. Check whether the content and the images are completely identical, if yes,
please get screenshots of these pages;
2. Keep the record of the communiations between you and the owner of the site;
3. Search the IP address and locate the URL (country, city , etc.);
4. Find the name of the plagiarist's company, and if it is a Chinese company, I
can find all the registration information about this company;
5. If the plagiarist's company is a Chinese company, I will suggest reporting this
company to AIC directly and the officials will notify them to cease immediately.
If not a Chinese company, strategy will be adjusted depending on the
6. If the plagiarist is only an individual rather than a company, it's better to find
other contact information of such person and contact him through any possible
If the content was removed after you reached out, do you really want to pursue legal action? Whether you have a case, taking legal action can be costly and time consuming. Have you suffered any damage? If not, I would move on. If you have suffered damage and want to pursue legal action, contact a lawyer. You can usually have a free consult to evaluate your options. Good luck.
Contact a lawyer that specializes in copyright and internet law, there are many steps that can be taken legally if the new site that was created using your content is affecting your business. - for example http://www.krinternetlaw.com/.
Aside of that, there is very little that can be done, those are situations that need to be handled by a lawyer to make sure your rights are protected.
Good luck that and hope it can be resolved soon !
